Lease Terms

LEASE TERMS AND CONDITIONS

  1. Surrender - On expiration of this lease, Tenant shall return all keys, etc. issued at check-in. A $10.00 charge shall be assessed for each set of keys not returned. The Tenant will leave the premises in as good condition as responsible use will permit. The Tenant shall not sublet the premises.
  2. Damage - Tenant shall be responsible for any loss or damage to the property and its fixtures or personal property of the Landlord during the term of this lease.
  3. Noise - No Tenant shall make or permit any disturbing noises on said premises by himself, his family, agents, servants or visitors, nor do, nor permit any such persons, to do anything that will interfere with the rights, comforts or convenience of other tenants or neighbors. No Tenant shall play upon or suffer to be played upon or operate any musical instrument, phonograph, radio, television, or other like device on the demised premises which shall cause excessive and annoying noise.
  4. Complaints - Any complaints to the Police Department concerning your behavior while in or on the premises shall constitute a break of this lease.
  5. Compliance - All Municipal Sanitary, Fire Regulations, and Recycling requirements must be complied with by all parties.
  6. Right of Access - Landlord (owner) or his agent shall have the right, but not the obligation, to enter into and upon said premises, or any part thereof, at all reasonable hours, for the purpose of inspection or showing for rental or sale, but Landlord agrees not to exercise said right in such a way as to unreasonably interfere with the quiet enjoyment of the Tenant.
  7. Subletting - Any subletting of this property shall constitute a break of this lease.
  8. Cancellation - All requests by the Tenant to cancel this lease must be in writing to Jesse Real Estate are subject to the property re-renting or acceptance by the owner. All deposit money will be retained until the property is re-rented at full price. If the property is not re-rented for full price, the difference will be due from the Tenant and/or be deducted from the deposit. All cancellations are subject to a 12% handling charge to Jesse Real Estate. Tenant agrees that all deposits and rental monies shall be held by the Owner, Not Jesse Real Estate. Owners are liable for all monies received.
  9. Unseen Rentals - Jesse Real Estate DOES NOT RECOMMEND renting "sight unseen". We will represent our inventory to you to the best of our abilities, but properties change over time, even during the course of one summer. Descriptive words like "nice" or "clean" are only opinions, and opinions differ. We very highly recommend that you, or someone you know, personally inspect your rental property BEFORE renting it. Should you rent "sight unseen", and for any reason are not happy with your rental accommodations, neither Jesse Real Estate nor your Landlord will be held accountable for refunds, deductions, or substitute accommodations. This is clearly understood.
  10. Repairs - Appliances and air conditioning are not guaranteed and refunds will not be given due to breakdown. Repairs will be made as soon as possible. Window air conditioners may not be installed without Owner's permission.
  11. Amenities - Tenant shall furnish linens, blankets, electric iron, beachtags and/or other such items the Tenant desires that are not included with this rental. A list of the property amenities is below, though no warranties and or compensation/refunds are given as to its accuracy.
  12. Commission - Landlord agrees to pay Jesse Real Estate a rental commission on the gross rental of this lease or any further leases to the Tenant herein named and a 7% sale commission if property is sold to said Tenant within two (2) years from the date of this agreement. The commission fees charged by Jesse Real Estate are for finding of tenants and collection of rents and does not represent a management fee for property maintenance.
  13. Agency - It is distinctly understood and agreed that the agent is acting as agent only and shall not, in any event, be held personally liable to the Landlord or the Tenant for the fulfillment of any terms of this lease.
  14. Approval - This lease is accepted subject to the approval of the owner and terminates upon default of any payment.
  15. Repair Authorization - The Landlord authorizes and gives permission to Jesse Real Estate to spend up to $200.00 as deemed necessary by the Agency for repairs and/or cleaning and /or supplies. The Landlord agrees to honor any bills, payments and/or reimbursement requests they receive covering this paragraph.
  16. NON-REFUNDABLE LEASE PROCESSING TRANSACTION FEE AND COMPENSATION DISCLOSURES - The Tenant agrees to pay Jesse Real Estate the non-refundable transaction fee as set forth above. This payment shall be made upon the signing of this lease. The Tenant agrees that this fee is totally non-refundable even if this lease is voided or canceled, and represents the efforts of Jesse Real Estate in processing this rental agreement. The Landlord and Tenant understand, acknowledge and agree that Jesse Real Estate represents the Owner only in this transaction, and the commission set forth in paragraph #16 above, as well as the non-refundable lease processing transaction fee, represent compensation from both parties in this transaction. Agency also receives compensation from CSA's SDPP, and Travel Insurance Programs.
  17. Megan's Law - Under New Jersey Law, the county prosecutor determines whether and how to provide notice of the presence of convicted sex offenders in an area. In their professional capacity, real estate licensees are not entitled to notification by the county prosecutor under Megan's Law and are unable to obtain such information for you. Upon closing, the county prosecutor may be contacted for such further information as may be disclosable to you.
  18. ADDITIONAL "OCEAN COLONY" CONDOMINIM LEASE PROVISIONS: (Ocean City Only) This condominium property includes parking space and storage cubicle. Occupancy at The Ocean Colony Condominium Association (OCCA), and the issuance of pool tags is strictly limited to 4 persons (for 1BR & 1BR converted units), 6 persons (2BR units) and 8 persons (3BR units). The tenant hereby agrees to comply and conform to the OCCA Master Deed, By-Laws, and Rules and Regulations governing this property.
  19. TRAVEL INSURANCE: Refunds will not be given for cancellations or occupancy delays due to deaths in the family, travel cancellations or delays, military deployment, medical emergencies, weather related events, evacuations and/or other events that would be considered Acts of God or out of the control of the Landlord. If the Tenant chooses not to purchase travel insurance, the Tenant may lose their ability to receive a refund if any of the above events occur. Please review the information and available coverages offered by CSA Travel Insurance posted as a link on our website under "Vacation Rentals". Travel Insurance reimburses for many non-refundable expenses due to certain unforeseeable circumstances that may result in cancellation or interruption of your vacation plans. Travel Insurance is a way to protect your vacation investment and should be considered.
  20. SECURITY DEPOSIT PROTECTION PLAN (SDPP): This lease includes a premium for SDPP that insures you for unintentional and accidental damages you or your guests may cause to the rental property during your stay, provided such damage is disclosed and reported to your Rental Agent prior to check out. The Policy will pay a maximum benefit of $1,500.00 You will still be responsible for any damages above the policy limit, and for any damages not covered by the SDPP. If during your stay an Insured Person causes any damage covered to real or personal property as a result of inadvertent acts or omissions, the Insurer will reimburse the Insured for the cost of repair and/or replacement of such property up to a maximum benefit of $1,500.00 Certain terms and conditions apply. Full details of the SDPP are contained in the Certificate of Insurance or Insurance Policy, and can be found on-line on our website. By submitting payment for this plan, you authorize CSA Travel Protection and Insurance Services to pay directly to Jesse Real Estate any amount payable under the terms and conditions of the SDPP. Please contact Jesse Real Estate if you do not wish to participate in this plan or assignment. If Tenant does not wish to participate in the SDPP, Tenant MUST notify Jesse Real Estate PRIOR to signing this Lease. Tenant shall then be required to pay a Security Deposit equal to the amount of rent being charged under this lease or $1,500, whichever is less. Please refer to the Security Deposit Clause in this Lease for more details.
  21. SECURITY DEPOSIT: By Law, Security Deposits must be released back to Tenants within 30 days after lease expiration. As a courtesy to Tenant, Landlord shall have 10 days following tenancy completion to object to the Tenant's security deposit return, and such request must be in writing. Deductions for security deposits include property damage, occupancy limit violations, and any violations of any terms and conditions of this lease that result in damages. Security deposits are not to be held for phone charges. Phone available for tenant usage must have phone blocks. Absent any written requests for security deposit monies from Landlord, security deposits will be automatically returned to the tenant after 10 days. In the event that security deposit monies are held by Landlord, Tenant clearly understands that Agent must abide by Landlord's request for such monies. Agent is not accountable to Tenant for the non-return of any security monies. Security Deposit disputes are between Landlord and Tenant only. In the event of a security deposit dispute where Tenant wishes to contact Landlord, Landlord authorizes Agent to furnish Landlord's contact information.
  22. GRILLING: Per New Jersey Codes and Standards, renters shall not be permitted to store or use (within 5 feet of any combustible material horizontally or vertically) any propane or charcoal grill.
